Terms of Service

These Terms govern your use of TokenHunger at tokenhunger.com (the “Service”), operated by the entity named in our Legal Notice. By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
TokenHunger lets you benchmark AI models on tasks and test cases you provide, ranking them by cost per correct answer. It is a commercial cloud layer built on the open-source costbench engine, which is licensed separately under its own terms. Free cost estimates are available without an account; running benchmarks requires an account and credits.
2. Accounts
You sign in with GitHub. You are responsible for activity under your account and for keeping your GitHub credentials secure. You must be at least 16 and able to form a binding contract. New accounts receive a one-time grant of free credits.
3. Credits, pricing and payment
- The Service runs on prepaid credits. Credits are purchased in packs through Stripe.
- When you start a run, credits are reserved to cover the estimated cost. After the run settles, you are charged for the actual spend and the unused reservation is returned to your balance.
- Prices are shown at checkout and may change for future purchases. Credits have no cash value, are non-transferable, and are not redeemable for cash except where required by law.
- Taxes may apply and will be shown or added as required.
4. Refunds
Because credits are consumed by running benchmarks against paid third-party model providers, purchased credits are generally non-refundable once used. If you are a consumer in a jurisdiction granting statutory withdrawal or refund rights, those rights still apply. If you believe you were charged in error, contact us at [email protected] and we will review it in good faith.
5. Acceptable use
You agree not to:
- submit unlawful content, malware, or data you are not authorised to share;
- submit personal data of others, or secrets and confidential information, into benchmark inputs (these are sent to third-party providers — see the Privacy Policy);
- abuse, overload, scrape, or circumvent rate limits or security of the Service;
- violate the terms of the underlying model providers; or
- resell or misrepresent the Service.
6. Third-party model providers
Benchmarks are executed against third-party AI providers. Their availability, pricing, outputs and accuracy are outside our control, and benchmark results are provided for comparison only, without any guarantee that a given model will perform the same on your production workload.
7. Your content
You retain ownership of the tasks and test cases you submit. You grant us a limited licence to process them to operate the Service (including transmitting them to the providers you select and storing your history). You can delete your history and account as described in the Privacy Policy.
8. Availability
The Service is provided on an “as is” and “as available” basis. We may modify, suspend, or discontinue features at any time. We aim for reliability but do not guarantee uninterrupted or error-free operation.
9. Disclaimer of warranties
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Cost figures and rankings are estimates and may differ from your actual provider bills.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits or data. Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the three months before the event giving rise to the claim.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or to comply with law. Unused credits may be forfeited on termination for breach.
12. Changes to these Terms
We may update these Terms. Material changes take effect when posted, indicated by the “last updated” date. Continued use after changes means you accept them.
13. Governing law
These Terms are governed by the laws of the jurisdiction of our operating entity, as stated in the Legal Notice, without prejudice to mandatory consumer-protection rights in your country of residence.
